CLOUD-VISION LLC · VERSION 2026-10-08
Terms of Service
Effective 8 October 2026. These Terms govern Vision Preview, operated by Cloud-Vision LLC ("we", "us"). When you accept these Terms, you agree on behalf of yourself and, if applicable, the organisation you represent. You must have authority to bind that organisation. Contact: info@cloud-vision.com.
1. Accounts and organisation access
You must be legally able to contract, provide accurate account information and protect your sign-in credentials, API tokens and folder email addresses. The service is not directed at children under 18. Organisation administrators control memberships and billing; other authorised members may work with shared content. Keep permissions current and tell us promptly about suspected unauthorised access. We are not responsible for resolving ownership disputes without reasonable evidence of authority.
2. What the service provides
Vision Preview generates screenshots in supported email-client environments and provides an HTML Builder, automated checks, shared review, comments and version approvals. Client availability, versions, operating systems and appearance support can change. Some labelled Outlook variants share an underlying capture engine; the interface identifies that provenance. The Builder's browser view is not a real-client proof. Pre-Checks are advisory and may be incomplete or unverified. Scores are not inbox-placement probabilities, security certifications or legal advice.
Approving a version records a person's decision, even where checks or captures are incomplete. It neither sends your campaign nor transfers responsibility for the final send to us. Review your content, audience, consent, links, sending configuration and applicable obligations yourself.
3. Render units and allowances
- One selected email-client label in one appearance uses one render when the request is accepted. Light and dark each count separately, including separately selected labels that share an underlying capture.
- A request for five clients uses five renders. A newly generated version uses its selected renders again. Adding a client not previously requested for that version uses another render. Automatic retries, viewing existing captures and hiding or reselecting previously requested clients do not add usage.
- Accepted requests reserve their render units; a failed capture does not automatically create a second charge or a refund. Contact support about persistent service failures. Any rights or credits required by law or your written agreement remain available.
- Allowances are shared by all organisation users and submission methods. Hourly limits cover the preceding 60 minutes; contracted daily limits cover the preceding 24 hours. Monthly usage for Stripe subscriptions follows the subscription period; Free and manually managed plans use calendar months in UTC unless your agreement specifies otherwise.
- Unused renders do not roll over. An over-limit request is rejected without starting or charging its renders; choose fewer clients, wait or change plan. A displayed daily capacity derived from an hourly limit is not immediately available capacity. Deleting a test does not restore used allowance.
Your account and the current pricing catalogue show applicable allowances. Unlimited plans remain subject to technical capacity, fair use and acceptable-use restrictions; they do not promise unlimited simultaneous captures or a fixed turnaround time. Enterprise's agreed custom limits override global defaults while that agreement applies.
4. Subscriptions, payment and cancellation
Basic and Standard are recurring monthly subscriptions processed by Stripe. Your checkout displays the price, currency, taxes where applicable and billing terms before payment. Renewal follows your subscription anniversary (with Stripe's month-end handling), not necessarily the first day of the month. You authorise recurring charges until cancellation. Enterprise is separately quoted and invoiced under its written agreement, which controls its fees, term and limits; automatic Stripe downgrades do not apply to Enterprise contracts.
Organisation admins may cancel renewal in Account. Cancellation prevents future renewals but does not erase already incurred charges or outstanding invoices. Paid access continues through the paid period; unpaid or cancelled subscriptions use Free limits. Payment failure may result in an automatic downgrade to Free while Stripe retries or the invoice remains unpaid. Recovery follows confirmed payment and subscription status. Downgrade is not account deletion; data remains subject to retention and storage rules. No automatic overage purchase is authorised merely by submitting renders.
Unless required by law, stated at checkout, or agreed in writing, payments are not refundable for unused capacity or a partial period. Contact support about a billing error promptly; this does not limit statutory dispute or refund rights. Optional upgrades or plan switches may involve prorations disclosed in the purchase flow. You remain responsible for applicable taxes and accurate billing details.
5. Price and plan changes
We may update the published pricing and plan allowances. Existing recurring subscription price changes apply only at a renewal after advance email notice, not retroactively to an already paid period. We will give at least 30 days' notice of a price increase, or more where required by law or contract, and explain how to cancel before it applies. If a notice would reach you too late for the next renewal, the change is deferred to a later eligible renewal. New purchases and voluntary plan switches use the price disclosed at that time. Enterprise changes follow the signed agreement.
Plan allowance settings can be updated centrally and take effect for all organisations on that plan. For a material reduction to a paid entitlement, we will provide appropriate advance notice and honour mandatory rights and existing contractual commitments. Your render-count model and plan limits are not silently reinterpreted to retroactively charge prior tests.
6. Your content, sharing and rights
You retain your rights in submitted HTML, email content and assets. You grant us the limited rights needed to receive, store, process, deliver to rendering environments, capture and display that content to provide and secure the service. You must have the necessary rights and lawful grounds for submissions, including personal data, linked assets and client communications. Use synthetic or redacted test data; do not submit passwords, payment card numbers, medical records or other sensitive or regulated information without a separately agreed arrangement.
Anyone holding an enabled public proof link can view its shared content, names, comments and checks. Guest names are self-reported. Screenshots may be served through publicly accessible CDN URLs; disabling a share link does not retract downloaded copies or necessarily revoke direct image URLs. Do not put confidential information in a public review. Mentions send the comment and a link by email to selected organisation members. You are responsible for whom you share with and for comments you submit.
7. Acceptable use
Do not use the service for unlawful content, harassment, impersonation, malware, phishing, credential theft, unsolicited messaging, infringing material, unauthorised scanning, or attempts to reach private networks. Do not bypass quotas, exploit shared links, steal tokens, disrupt devices or resell access without permission. Do not submit content that you are prohibited from disclosing to our rendering and infrastructure providers. We may investigate reports and restrict abusive or unsafe activity using proportionate measures.
8. Availability, storage and third parties
Capture timing and results depend on queues, mail delivery, third-party clients, network resources, hardware and content. Maintenance, failures and provider changes may interrupt service. We do not promise uninterrupted availability, particular latency, identical results for every recipient or preservation of every supported client unless separately agreed. Reasonable updates may change features without removing your mandatory rights.
The service is not a backup or archival system. Retained email source for adding clients is time- and storage-limited and may expire before screenshots. Export what you need. Our Privacy Policy explains processing and retention. Third-party websites, remote assets and services have their own terms and practices; testing may request resources from them.
9. Suspension and termination
You may stop using the service and cancel renewal at any time. Contact support to request account or organisation deletion after securing necessary exports. We may suspend access for material breach, unlawful activity, nonpayment or a security risk; where practicable, we will explain the reason and allow a reasonable opportunity to resolve it. Immediate restrictions may be necessary to protect users or systems. We will respect any refund, notice, data-access or other remedies required by applicable law.
10. Warranties and responsibility
To the extent permitted by law, the service is provided as available without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that every defect will be detected or that a campaign will reach the inbox, achieve a business result or comply with every requirement. Nothing here excludes guarantees that cannot lawfully be excluded.
To the extent permitted by law, neither party is liable to the other for indirect or consequential loss, lost profits or lost business opportunity arising from the service. Our aggregate liability under these Terms is limited to the fees your organisation paid for Vision Preview during the 12 months preceding the event, or USD100 if greater. This limitation does not exclude fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, mandatory data-protection liability, or any liability that cannot legally be limited. Your payment obligations and each party's mandatory legal duties are unaffected.
For business customers, you agree to reimburse reasonable losses and defence costs arising from a third-party claim that your unlawfully submitted content infringes their rights or your intentional misuse violates law, to the extent caused by you. This does not cover our own wrongful conduct. We must give prompt notice, reasonable cooperation and a fair opportunity to participate in the defence; no settlement may impose an obligation on you without your consent.
11. Resolving concerns and changes to these Terms
Please first contact us to resolve a concern informally. Nothing here prevents you from contacting a regulator, seeking urgent relief or using a court with competent jurisdiction. Applicable mandatory consumer and privacy laws prevail; these Terms do not impose mandatory arbitration or waive a non-waivable right.
We may revise these Terms with an updated version and effective date. We will give advance notice of material adverse changes where required and seek renewed agreement where necessary. Changes do not retrospectively remove accrued rights. A written Enterprise agreement prevails where it conflicts. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a permanent waiver.
